Assumption of Risk, Release and Indemnification

BY SIGNING THIS DOCUMENT, YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT –PLEASE READ CAREFULLY!

In consideration of using the service, equipment and facilities of The Paint Riot  (hereinafter “TPR”), I hereby acknowledge and agree to the following terms and conditions:

In this Release Agreement, the term “Activities” shall include but shall not be limited to all activities, functions, events, orientations, instruction sessions, competitions and services provided, arranged, organized, sponsored or authorized by TPR, including but not limited to: paint, splattering and playing inside The Paint Riot tent with one or more instrument(s), including, but not limited to a canvas, paint brushes, and paint bottles in a designated room, and other related activities.

1. ASSUMPTION OF RISK

I acknowledge that participation in The Paint Riot involves physical activity in a tented environment that may include the use of paint, art supplies, low lighting, sound effects, and interactive materials. I understand the potential risks, including but not limited to:

• Slips, trips, or falls due to paint or flooring surfaces

• Exposure to paint that may stain clothing or shoes, despite the use of provided personal protective equipment (PPE)

• Temporary discomfort due to lighting, noise, or physical exertion

• Risk of allergic reaction to non-toxic paint or materials used

I voluntarily assume all risks associated with participation, including those arising from the negligence of The Paint Riot, its employees, contractors, or affiliates.

2. MEDICAL CONDITIONS, EMERGENCY CARE AND SOBRIETY

I confirm that I (or my child) am physically able to participate in the activities offered by The Paint Riot and will inform organizers of any relevant medical conditions, allergies, or physical limitations prior to the event. I understand that The Paint Riot staff are not medical professionals and cannot administer medication or provide medical care beyond basic first aid. In the event of an emergency, I authorize The Paint Riot to seek medical assistance as needed and accept full responsibility for any related costs. I understand it is my responsibility to communicate any conditions such as asthma, epilepsy, severe allergies, or sensory sensitivities in advance to help ensure a safe experience. I also confirm that I (or my child) am not under the influence of alcohol, cannabis, or any impairing substances at the time of participation, and I understand that being intoxicated may result in the refusal of service for safety reasons.

3. RELEASE OF LIABILITY AND WAIVER OF CLAIMS

I waive any and all claims and release The Paint Riot, including its owners, officers, employees, contractors, agents, affiliates, successors, and assigns (collectively, the "Releasees"), from all liability for any loss, damage, injury, or expense, including death, that I may suffer or that my next of kin may suffer, as a result of my participation in the Activities.

This release applies to any cause whatsoever, including but not limited to:

• Negligence (including the failure to take reasonable steps to protect or safeguard participants)

• Breach of contract

• Breach of any statutory duty of care under applicable occupiers' liability legislation or otherwise

• Failure to provide adequate instruction, supervision, or warnings regarding the risks associated with the Activities

I fully understand and voluntarily accept the risks, dangers, and hazards involved in participating in The Paint Riot’s mobile events, including but not limited to:

• Physical activity on potentially slippery surfaces

• Exposure to black lights or UV lighting

• Contact with non-toxic paints that may stain clothing, shoes, or personal items

• Sensory stimulation that may not be suitable for all individuals

I covenant not to make or bring any such claims against The Paint Riot or any other Releasee, and I forever release and discharge all such parties from liability.

4. INDEMNITY AND HOLD HARMLESS

I agree to hold harmless and indemnify The Paint Riot and the Releasees from any and all liability for:

• Damage to property

• Personal injury or death of any third party

• Any legal fees, costs, or expenses incurred as a result of my actions during participation in the Activities

This indemnity applies whether the incident arises from my own conduct or from that of a minor for whom I am responsible.

5. MEDIA RELEASE AND PHOTO CONSENT

By participating in The Paint Riot’s mobile events, I understand that photos and videos may be taken during the experience for the purpose of sharing the fun, promoting future events, and showcasing what The Paint Riot is all about.

I give permission for The Paint Riot to use photos or videos that may include my (or my child’s) image, voice, or likeness for promotional purposes. This may include, but is not limited to, use on social media, the company’s website, printed materials, or other marketing platforms. I understand that these images will be used in a respectful and appropriate way, and I will not receive payment or royalties for their use.

I acknowledge that The Paint Riot does not claim ownership over my personal image or likeness and that this permission simply allows them to share event-related content without risk of legal claims from me or my representatives.

If I prefer not to be photographed or recorded, I will notify The Paint Riot staff at the start of the event, and every reasonable effort will be made to respect my request.

BY COMPLETING THIS FORM, I HEREBY ACKNOWLEDGE THAT I AM NOT INTOXICATED NOR HAVE I CONSUMED ANY OTHER SUBSTANCES THAT MAY RESULT IN MY JUDGEMENT BEING IMPAIRED. I HEREBY ASSUME FULL RESPONSIBILITY FOR MY ACTIONS, RISKS, DANGERS, AND HAZARDS RESULTING FROM THE USE OF THE FACILITIES AND PARTICIPATION IN THE ACTIVITIES WHILE UNDER THE INFLUENCE OF ALCOHOL OR MIND-ALTERING SUBSTANCES. I UNDERSTAND THAT I AM GIVING UP CERTAIN RIGHTS WHICH I OR MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE. I AM AT LEAST 18 YEARS OLD AS OF THE DAY THIS FORM WAS FILLED OUT. I FREELY ACCEPT AND ASSUME ALL RISKS, DANGERS AND HAZARDS AND THE POSSIBILTY OF RESULTING PERSONAL INJURY, DEATH, PROPERTY DAMAGE OR LOSS DIRECTLY OR INDIRECTLY ASSOCIATED WITH MY PARTICIPATION IN THE ACTIVITY. I HAVE READ THIS REALEASE AGREEMENT AND FULLY UNDERSTAND ITS CONTENTS AND VOLUNTARILY AGREE TO ITS TERMS.

I agree to wear all required safety gear provided by TPR, including goggles and a coverall or poncho. If any safety gear is removed, worn improperly, or not used at my discretion, I accept full responsibility for any resulting injuries.

I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THIS ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT AND I AGREE TO BE BOUND BY ITS TERMS.

PARENT’S OR GUARDIAN’S ADDITIONAL AGREEMENT AND INDEMNIFICATION (Must be completed for participants under the age of 18)

In consideration of  (Minor) being permitted to participate in TPR activities and to use its equipment and facilities, I, the parent or guardian of the minor agree on behalf of the minor to the above assumptions of risk, release of liability and waiver of claims and to release, indemnify and hold harmless TPR from any and all claims which are brought by, or on behalf of the minor, and which are in any way connected with such participation or use by the minor. I further certify that I am the parent or guardian of the minor on this agreement and certify that I will be accompanying the minor during their session booked. I hereby give approval to the participation in TPR activities and/or use of its equipment and facilities by the minor.
